Terms and conditions

Please read these Terms and Conditions (“Agreement”) carefully before using VetScript services. By using VetScript services, you agree to be bound by its terms. 

This Agreement is between VetScript Pty Ltd (“VetScript”) and the veterinary practice (“You” or “Vet”) identified in the VetScript enrolment form. This Agreement governs your use of VetScript’s services, which include creating and managing electronic prescriptions (e-scripts) throughout the Prescription lifecycle. 

1. Definitions

  • VetScript Services: The prescription exchange service provided by VetScript, enabling the creation and management of the life cycle of electronic prescriptions (e-scripts) within a veterinary Practice Management System. 
  • Practice Management System (PiMS): The software used by the veterinary practice to manage bookings, consultations, prescriptions and medication information.
  • e-script: An electronic prescription created within the PiMS.

2. Responsibilities

  • VetScript Responsibilities:
    • Provide access to the VetScript services.
    • Ensure the integrity and security of data transmitted through the VetScript services.
    • Ensure that all prescription information complies with the guidance provided by the Australian Veterinary Association (AVA) that reflects state and territory regulations.
  • Vet Responsibilities:
    • Use the VetScript services in compliance with this Agreement as well as all applicable veterinary standards and laws.
    • Maintain the confidentiality of login credentials and any sensitive information.
    • Notify VetScript within 24 hours of any unauthorised use or security breach.

3. Data Privacy and Security

VetScript will implement and maintain reasonable security measures to protect the confidentiality, integrity and availability of data processed through the VetScript services. Examples include:

  • Encryption: All data transmitted through VetScript services is encrypted.
  • Access Control: Strict access controls are maintained to ensure only authorised personnel can access sensitive information.
  • Security Testing: VetScript conducts regular security testing to identify and mitigate vulnerabilities.

4. Financial Terms

VetScript does not charge fees to vets for using its services. The entities who own and operate the various PiMS systems in the market may charge fees for various services and features. This is outside of VetScript’s control.

5. Compliance with Regulations

You agree to comply with all applicable local and federal laws. VetScript is not responsible for any non-compliance by you or your organisation.

6. Flexibility for Future Changes

VetScript reserves the right to update the Terms and Conditions of its services within this Agreement to reflect changes in technology, regulations, or business practices. VetScript will provide 30-days written notice of material changes to this Agreement.

7. Professional Conduct with Pharmacies

To maintain the integrity and utility of VetScript services, any direct relationship established between you, your organisation and a connected pharmacy outside the scope of this Agreement is considered a breach of this Agreement. Such actions may lead to the termination of services provided under VetScript, including access to VetScript services and support. Any concerns regarding VetScript services should be promptly communicated to VetScript for resolution.

8. Dispute Resolution

In the event of a dispute arising from this Agreement, the parties agree to attempt to resolve the dispute through good-faith negotiations. If negotiations fail, the dispute will be resolved through appropriate legal avenues to ensure a fair resolution process.

9. Termination

  • By Vet: You may terminate this Agreement at any time with 30-days written notice.
  • By VetScript: VetScript may terminate this Agreement for any reason with 30-days written notice or immediately for cause.
  • Effect of Termination: Upon termination, your access to VetScript services will be terminated.

10. Intellectual Property

All intellectual property rights associated withVetScript services, including any modifications or improvements, are owned by VetScript. This Agreement does not grant you any ownership or usage rights.

11. Confidentiality

You agree to maintain the confidentiality of any non-public information received from VetScript. This obligation survives the termination of this Agreement.

12. Performance Metrics

VetScript may monitor and analyse the performance of its services. You agree to provide reasonable assistance to VetScript in collecting data necessary for this purpose.

13. Miscellaneous

  • Governing Law: This Agreement is governed by the laws of the jurisdiction in which VetScript and its users operate. 
  • Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements.
  • Amendments: Any amendments to this Agreement must be in writing and signed by both parties.
